1. Who We Are

   1.1 Family Funeral Notice Limited is a private company registered in Scotland as Company Number SC554456.  Our registered address is Clyde Office Suite 2/3, 48 West George Street, Glasgow G2 1BP, Scotland.  We operate the web site www.familyfuneralnotice.com, send client SMS’s and provide the linked online Funeral Notices published by that web site.

2.Definitions

   2.1. Family Funeral Notice Limited is hereinafter referred to as ‘the company,’ ‘we,’ ‘us,’ and by the adjectives ‘our’ and ‘ours.

   2.2 Agent means our accredited sales agent who produces current authorisation on demand

   2.3 Users of our web sites are hereinafter called Customers and the terms ‘you,’ and the adjectives ‘your,’ ‘yours are applied to them. The term is understood to include all staff and agents employed or directed by the principal customer.

   2.4 Client means the family of a deceased person served by one of our customers.

   2.5 Documentation means this document, our Web Site Terms and Conditions, our Conditions and Terms of Business and all instructional material on our Web Site or provided by our accredited Agents.

   2.6 Our web site www.familyfuneralnotice.com is hereinafter referred to as ‘the web site’ or ‘our web site.’

   2.7 Our online published Funeral Notices are hereinafter referred to as ‘notices.’

   2.8 Customer Content hereinafter refers to material published through our web site by our customers.

   2.9 Malware is any material forming part of your usage that contains harmful software such as viruses, Trojan horses, worms, keystroke loggers, spyware, ransomware, adware or similar computer code designed to affect adversely the operation or security of any computer software belonging to the company, our customer s or third parties connected to the use of our web site.

   2.10 Services means the facility offered to the customer to publish online Funeral Notices on behalf of its clients and includes our web site and documentation

3. Preamble

   3.1 This service usage policy sets out the manner in which you may use our web site www.familyfuneralnotice.com, our text messages and the online Funeral Notices published by us through that site. It applies to all customers of, and visitors to these sites and all customers who access the services provided through them.  By using our web site and/or the services provided through it and the notices, you agree to accept and abide by all restrictions imposed by this Service Usage Policy, which are in addition to those governing the terms of our web site use published at Terms of use

      3.2.7. Sending, or transmitting, causing to be sent or transmitted, or assisting any third party to send or transmit any unsolicited promotional or advertising material via our services, or any similar activity commonly covered by the accepted definition of ‘spam.’

      3.2.8. Causing or permitting any malware to be spread via our web site, text messages or notices

      3.2.9. Reproducing, duplicating, copying, leasing or selling any part of our web site as described in our terms of use thereon at Terms of use

      3.2.10. Accessing without our authority, interfering, damaging or disrupting the following: -

         3.2.10.1. Any part of our web site

         3.2.10.2. Any software used in providing our services

         3.2.10.3. Any equipment, network or device on which our service depends

         3.2.10.4. Any of the above, including software, belonging to or owned by any third party

4.Customer Content Standards

   4.1These standards apply to any and all material published by our customer s from our web site, and to any service associated with such material. Compliance with both the letter and the spirit is required, and the standards apply to each part of the Customer content as well as to the whole.

   4.2. Factual content must be accurate to the best of the knowledge of the customer and it is the responsibility of the customer to ensure this

   4.3. Customer content must comply with all applicable law of Scotland and the United Kingdom of Great Britain, and of any other country from which it may be posted

   4.4. Customer content may not: -

      4.4.1 Contain defamatory, obscene, offensive, inflammatory or sexually explicit material, or be intended or likely to deceive any person,

      4.4.2. Promote violence or discrimination against any person or group relating to race, religion, nationality, age, sex or sexual orientation,

      4.4.3. Infringe or cause, in whole or in part, infringement of any copyright, trademark or intellectual property right of any person, including corporate persons,

      4.4.4. Be in breach of any legal obligation or duty to a third party, such as contractual duties or confidences,

      4.4.5. Be threatening, abusive, invasive of privacy, or likely to alarm, embarrass, harass, annoy or cause inconvenience to any person,

      4.4.6. Seem to impersonate another or misrepresent your identity or affiliation to any other person, including corporate persons,

      4.4.7. State or suggest that it comes from us unless we have authorised this in writing, or

      4.4.8. Incite, advocate, promote or assist any unlawful act not covered by the above.

5.Family Funeral Notice Indemnity

   5.1. The customer shall indemnify, defend and hold us harmless against claims, legal actions, proceedings losses, damages, expense and costs, including court costs without limitation and reasonable legal fees arising out of or in connection with the customer content or the customer’s or client’s use of our services or documentation, provided that

7. Family Funeral Notice Indemnity

   7.1. The customer shall indemnify, defend and hold us harmless against claims, legal actions, proceedings losses, damages, expense and costs, including court costs without limitation and reasonable legal fees arising out of or in connection with the customer content or the customer’s or client’s use of our services or documentation, provided that

      7.1.1. The customer is given prompt notice of such claim should it first be made against us, and

      7.1.2. We provide reasonable co-operation to the customer in the defence and settlement of such claim as described here, at the customer’s expense and

      7.1.3. The customer is given sole authority to manage all matters pertaining to the defence and settlement thereof.

   7.2 the company shall under no circumstances be held liable to the Customer in respect of claims arising from

      7.2.1. Modification or alteration of the Service and/or Documentation by any natural or legal person other than the company, or

      7.2.2. Use of our Service by the Customer in a manner contrary to or other than the instructions contained on our web site or given by our agent, or

      7.2.3. Continued use of our Services by the Customer after notification of an actual or alleged breach of these conditions

8. Customer Indemnity

   8.1. We undertake to defend the customer, its authorised users and associates against any claim that our services infringe any United Kingdom patent effective at the date that the customer enters a valid contract with us, or any trade mark, copyright, database right or right to confidentiality, and to indemnify the customer for any amounts awarded against it in judgement or settlement for such claim, provided that

      8.1.2. We are given prompt notice of such claim should it first be made against the customer; and

      8.1.3. The customer provides reasonable co-operation to us in defence of such claim, at our expense and

      8.1.4. We are given sole authority to defend such claim and

      8.1.5. Such claim does not arise from any Customer usage covered by the prohibitions above.

      8.2. In the event of any such infringement claim, the Company may obtain the right for the Customer to continue to use our service while we attempt to modify our services to address the infringement so as to remove it.  If this proves impossible, the Company may terminate our Contract with the Customer upon two business days’ notice, and remit a pro rata amount in full and final settlement of all claims against us by the Customer, and without obligation to pay any Customer damages or other costs.

9. Suspension or Termination of Service

   9.1. Any breach of this Service Usage Policy by you through your use of our services will be assessed by the company at its sole discretion.  Failure to comply constitutes a further breach of our web site Terms of Use published at Terms of use. We may take such action as we deem appropriate, including, but not limited to any or all of the following: -

      9.1.1. Issuance of a warning to you of possible suspension of our services or

      9.1.2. Withdrawal, whether temporary or permanent, of your right to use our web site and any services associated with it, including cancellation of your account and

      9.1.3. Removal, either temporary or permanent, of any customer content uploaded by you to our web site directly or via any services associated with it, and/or

      9.1.4. Legal proceedings against you for the recovery of all costs incurred by us as a result of such breach, and/or consequent damage to our business and/or

      9.1.5. Disclosure of any customer content provided by you to law enforcement agencies should this be necessary.

      9.2. We will not be liable for damage suffered by you as a result of actions we may take that are covered by this Service Usage Policy

10.Changes to our Service Usage Policy

   10.1. We may change this Service Usage Policy at any time by amending this document. Although we will take reasonable steps to inform customers of this, the responsibility to comply with it rests with, and is legally binding, upon you. Where any individual clause or provision contained in this policy contradicts or nullifies any provision of the web site Terms of Use, our Privacy Policy, Terms and Conditions or Disclaimer, such contradiction or nullification shall not be held as invalidating the rest of this Service Usage Policy.
